Waiver, Assumption of Risk, and Hold Harmless Agreement

This General Waiver, Assumption of Risk, and Hold Harmless Agreement (“Agreement”) is entered into by the undersigned responsible party (“Responsible Party”) for participation in activities and services offered by Country Road Canines, LLC and Triple Play Dog Sports (collectively, “the Facility”).


This Agreement applies to training, boarding, daycare, swimming, dock diving, private rentals, classes, lessons, events, and any other services or activities offered by the Facility.


1. Acknowledgment of Risk

The Responsible Party understands that participation in dog-related activities is not without risk. These risks may apply to the Responsible Party, their dog, family members, guests, handlers, spectators, other people, and other dogs on the property.


The Responsible Party understands and acknowledges that there are inherent risks involved with dog ownership, handling, training, care, swimming, dock diving, group environments, and other dog-related activities. These risks may include, but are not limited to, injury, illness, dog bites, dog fights, slips, falls, collisions, property damage, stress, escape, injury to dogs or people, and the transmission of disease.


2. Health and Fitness of Dog

The Responsible Party understands that dogs taking part in physical activity should be healthy enough to do so. The Responsible Party acknowledges that it is their responsibility to consult with a veterinarian before allowing their dog to participate in training, swimming, dock diving, daycare, boarding, or any other physical activity if there are any concerns about the dog’s health, soundness, behavior, or fitness level.


The Responsible Party confirms that, to the best of their knowledge, their dog is healthy, free of contagious illness, and current on required vaccinations or approved titers as required by the Facility. The Responsible Party understands that they are responsible for providing accurate vaccination and health information for their dog.


3. Private Property and Right to Refuse Service

The Responsible Party understands that the Facility operates on private property and is accessible by appointment or event attendance only.


The Responsible Party further understands that the Facility reserves the right to refuse service, deny entry, remove any person or dog from the property, or stop participation at any time for safety, health, behavior, policy violations, lack of control, disorderly conduct, or any other reason the Facility deems necessary.


4. Release and Hold Harmless

The Responsible Party, on behalf of themselves and anyone attending with them, hereby releases and agrees to hold harmless the Facility, including its owners, staff, contractors, trainers, volunteers, representatives, property owners, and affiliates, from any and all claims, injuries, damages, losses, liabilities, costs, expenses, or causes of action arising out of or related to participation in any service, activity, event, or use of the property.


This release includes, but is not limited to, claims related to injury, illness, death, property damage, dog behavior, dog-to-dog interactions, dog-to-human interactions, facility use, training activities, swimming, dock diving, boarding, daycare, lessons, rentals, classes, events, and any other service or activity provided by the Facility.


5. Responsibility for Actions and Damages

The Responsible Party agrees to accept full responsibility for their own actions, the actions of their dog, and the actions of any family members, guests, handlers, or spectators attending with them.


The Responsible Party further agrees to be responsible for any injury, damage, veterinary care, medical care, property damage, or related expenses caused by them, their dog, or anyone attending with them.


6. Indemnification

The Responsible Party agrees to indemnify and hold harmless the Facility, including its owners, staff, contractors, trainers, volunteers, representatives, property owners, and affiliates, from and against any claims, damages, losses, expenses, or legal fees arising out of or related to the Responsible Party’s participation, their dog’s participation, or the actions of anyone attending with them.


7. Voluntary Participation and Assumption of Risk

The Responsible Party understands that participation in any service, activity, lesson, rental, class, daycare, boarding reservation, or event is voluntary.


The Responsible Party knowingly and voluntarily assumes all risks associated with entering the property and participating in any activity or service offered by the Facility.


8. Acknowledgment and Agreement

By signing below, the Responsible Party confirms that they have read, understand, and agree to this General Waiver, Assumption of Risk, and Hold Harmless
